These terms cover your use of PHQR (Phone Home QR): phqr.app, phqr.org, and the stickers and tags that link to them. PHQR is a service of Ascend Networks LLC (“we”, “us”), and these terms are an agreement between you and Ascend Networks LLC. By using PHQR you agree to them. Our privacy policy explains how we handle personal information.
What PHQR does
PHQR lets owners register stickers and tags on their belongings, and lets anyone who finds one contact the owner through PHQR. We help people get in touch; we do not guarantee that a lost item will be found or returned.
Accounts
- Accounts are for people aged 18 and over. Finders don't need an account to contact an owner.
- You need an account to claim stickers. Keep access to your email secure.
- Give accurate information, and only claim stickers you have in hand.
- You are responsible for what happens under your account.
Stickers and tags
- A sticker belongs to whoever claims it first, and each item has one sticker. You can transfer it to someone, release it so someone else can claim it, or retire it if it is damaged or lost. Retiring is permanent.
- Stickers and tags keep working with PHQR's free features for as long as PHQR operates.
- You may transfer a sticker to someone else. Once they accept, the sticker and its features belong to their account and no longer to yours.
Texts
Setting up an account needs a US mobile number, confirmed with a code we text to it. By ticking the box when you add a number you agree that PHQR may text it: “Text me scan alerts and finder messages. Msg & data rates may apply. Reply STOP to opt out. Reply HELP for help.” We text scan alerts, messages from finders and sign-in or confirmation codes, and nothing else (no marketing). How often depends on how often your stickers are scanned and how much finders write. Reply STOP to any text to opt out of texts to that number, START to turn them back on, and HELP for help. Your carrier's message and data rates may apply. Carriers aren't liable for delayed or undelivered messages.
Texts always come from PHQR's number: finders never see your number, and you never see theirs. A finder who gives their number to be texted agrees to get the owner's replies by text and can reply STOP the same way.
Text alerts and replies included. Fair use: texts are for normal lost-and-found use, about 300 a month per account. To prevent abuse, texts also have daily limits (20 per chat and 50 per account each day). When a limit is reached, we pause texts until it resets; scan alerts and messages keep working in the app and by email.
Purchases and refunds
Stickers and tags come with a 30-day money-back guarantee. If you aren't happy, contact [email protected] within 30 days of delivery for a full refund.
Your content
You keep ownership of what you add (item details, photos, messages). You give us permission to store it and show it as the service requires, for example showing your item photo and note to whoever scans your sticker. Don't upload anything you don't have the right to share, and avoid serial numbers, addresses or other personal details in photos and notes.
Acceptable use
Don't use PHQR to:
- harass, threaten, scam or mislead other people, including owners and finders;
- send spam, or scan or look up codes in bulk;
- break the law, or interfere with or try to get around PHQR's security;
- impersonate someone else or claim items that aren't yours.
Don't upload or share illegal content of any kind. To keep PHQR safe, we may check uploaded photos and files against known illegal material, remove content that breaks these terms or the law, and report it to the authorities as the law requires, including reporting child sexual abuse material to the National Center for Missing & Exploited Children.
Owners can block and report chats. We may remove content, block chats, and suspend or close accounts that break these terms.
Finders and rewards
Finders don't need an account. Any reward is a promise between the owner and the finder; PHQR is not a party to it and does not handle payments. Meet in safe, public places when returning items.
Availability
We work to keep PHQR running, but it may sometimes be unavailable or change. We may update features or stop offering parts of the service, with notice where we reasonably can.
Disclaimers and limitation of liability
PHQR is provided “as is” and “as available”. To the extent the law allows, we are not liable for lost, damaged or unreturned items, for what other users do, or for indirect, incidental, special or consequential losses.
To the extent the law allows, our total liability for any claim arising from or relating to PHQR is limited to the greater of the amount you paid us in the 12 months before the claim arose, or $50.
Ending your use
You can stop using PHQR at any time. To have your account deleted, email [email protected]. We may suspend or close accounts that break these terms.
Changes to these terms
We may update these terms. We will change the date above and, for significant changes, email account holders before they take effect.
Governing law and venue
These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute arising from them or from PHQR will be brought in the state or federal courts located in Broward County, Florida, and you and we consent to those courts' jurisdiction.
